Terms of Use

These Terms of Use (“Terms”) govern your use of the AreaMap iOS app (“AreaMap”, “the app”), made by Velocity Apps (“we”, “us”). By downloading or using AreaMap you agree to these Terms and to Apple’s Licensed Application End User License Agreement (the “Standard EULA”). If these Terms conflict with the Standard EULA, these Terms apply to the extent permitted.

1. Measurements are estimates, not a survey

Results depend on satellite imagery (which can be offset, outdated or distorted), on where you place points, and on your device’s GPS accuracy. Material estimates are rough guides; actual quantities vary with products, terrain and waste. Confirm anything important, such as a purchase, sale, permit, dispute or construction, with a licensed surveyor or qualified professional. You’re responsible for decisions you make using the app.

2. AreaMap Pro subscription

• Subscription required. Measurement results, saving, walking a boundary, exports and estimates require an AreaMap Pro subscription. Without one, you can explore the map and draw shapes, but results are locked.
• Free trial. New subscribers may get a free trial (currently 3 days). Unless you cancel at least 24 hours before the trial ends, the subscription starts and you’re charged the yearly price.
• Price. The price and billing period are shown in the app before you buy, in your local currency (currently $49.99 per year in the US). Introductory offers, such as a discounted first year, renew at the regular yearly price shown with the offer unless you cancel. Time-limited offers are available only for the period stated in the app.
• Payment and renewal. Payment is charged to your Apple ID when you confirm the purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and renewal is charged within 24 hours before the period ends.
• Managing and cancelling. Manage or cancel in Settings › [your name] › Subscriptions. Cancelling stops future renewals; access continues until the end of the paid period.
• Refunds. Purchases are processed by Apple, and refunds are handled by Apple at reportaproblem.apple.com.

3. Your data

Your measurements are stored on your device, as described in our Privacy Policy. You’re responsible for backing up your device; we can’t recover data we never receive. You can export your measurements at any time.

4. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use AreaMap on Apple devices you own or control, as permitted by the Standard EULA. You agree not to copy, modify, reverse engineer or redistribute the app, or to use it unlawfully.

5. Maps

Map imagery, search results and Look Around are provided by Apple and its data partners and are subject to Apple’s terms. Availability and quality vary by location.

6. Disclaimers

AreaMap is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non-infringement.

7. Limitation of liability

To the fullest extent permitted by law, Velocity Apps is not liable for any indirect, incidental, special, consequential or punitive damages, or for losses arising from reliance on measurements or estimates. Our total liability for any claim relating to the app is limited to the amount you paid for AreaMap in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not apply to you in full.

8. Apple

These Terms are between you and Velocity Apps, not Apple. Apple is not responsible for AreaMap or its content, has no obligation to provide maintenance or support, and is not responsible for addressing claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Changes and termination

We may update AreaMap and these Terms. For significant changes we’ll update the date above and let you know in the app. You can stop using AreaMap at any time by deleting it.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
